Conditions for ANBI
To be designated as an ANBI, an institution must meet several conditions.
An ANBI enjoys several tax benefits:
- An ANBI is exempt from inheritance tax or gift tax for legacies and donations that the institution uses for the general interest.
- If an ANBI makes donations for the general interest, the recipient is not required to pay gift tax.
- An ANBI is eligible for a refund of energy tax.
- Volunteers working for an ANBI, under certain conditions, are considered to make a gift to an ANBI.
- Donors to an ANBI may deduct their donations from income or corporate tax.
- To qualify for the deduction of periodic donations, the donor and the ANBI must record the donation in an agreement.
